American Indian Children Still Removed From Homes at High Rates

 repost from 11/9/2015

By LEX TALAMO

Almost 40 years after the Indian Child Welfare Act (ICWA) passed, American Indian children are still being removed from their homes in highly disproportionate numbers– at a rate almost three times higher than any other ethnicity, excepting African American children.

Minnesota leads the list of states with the worst rates of disproportionate removal– where American Indian children are overly represented in the foster care system– according to a June 2015 report from the National Council of Juvenile and Family Court Judges.  Other states with high numbers of disproportionate removal include Nebraska, Iowa, Idaho, Wisconsin, Washington, South Dakota and Oregon.

Even in states without dramatic removal rates– like Arizona and New Mexico– many American Indian children find themselves removed from their families and placed in group homes, treatment centers or foster care.

In McKinley County, New Mexico,  American Indian children make up 73 percent of all children in foster care, according to a 2015  third quarter report from the New Mexico Children, Youth and Families Department (CYFD).  And in Arizona, over 1,300 American Indian children were in the foster care system as of March 31, 2015, according to a Department of Child Safety Child Welfare Report.

The Indian Child Welfare Act of 1978 applies to any child of American Indian descent who is an enrolled member or eligible for enrollment in any federally recognized tribe. When an American Indian child enters state custody, the state must contact the child’s tribe, and the tribe has the right to transfer the case to tribal court or to participate in court proceedings.

In order to help American Indian children stay connected to their tribal cultures and identities, ICWA also established a placement preference that starts with the child’s extended family and clan relatives and then progresses to enrolled members of the child’s tribe and enrolled members from any tribe– with placement of the child in a non-Indian family as a last resort.

“Any child who might be Native American, they have a [cultural] identity,” said Regina Yazzie, Program Director of the Navajo Nation Division of Social Services.  “It’s a benefit.”

Yazzie added that across the country, state agencies struggle to find American Indian foster families for children.  Finding placement families on reservation land can prove equally challenging.

Data from the Children, Youth and Families Department of New Mexico shows there are currently 43 American Indian foster care providers who have 79 placements available– nowhere near enough for the 262 American Indian children in New Mexico’s foster care system.  Melissa Otero from AdoptUsKids.org also said through an email correspondence that less than 1 percent of all AdoptUsKids placement families identify as American Indian.

When speaking with the Navajo Post, several tribal members mentioned hardships on reservations that negatively impacted families’ ability to foster– including poverty, poor housing, poor mental health care, suicide, and addiction.

“Part of what’s going on [is] drug and alcohol numbers are sky high,” said one tribal member, who wished to remain anonymous in order to be able to speak freely. “There are not a lot of healthy families. There are tons of families that care, but it takes structure, it takes money [to foster], and so many families are overwhelmed with the day to day living, how could they bring another child into their home?”

For the San Carlos Apache Tribe, methamphetamine poses a particular devastating problem.   Social services Director Terry Ross said that the reservation currently has an “epidemic of mothers with meth-exposed babies.”

“We try to work with the family, but when mothers are addicted to meth… it’s hard,” Ross said. “We can’t make people do anything. They have to want to change for their child.”

Many tribes offer social services like counseling, parenting classes, detox centers and emergency supplies to American Indian families in need. But representatives from several tribes mentioned that funding is limited and resources are stretched thin, so that American Indian children continue to find themselves in foster care– where many undergo significant trauma and loss of identity when growing up separated from their tribes, communities, and cultures.

A Sense of Belonging

Sandra White Hawk, an enrolled member of the Sicangu Lakota of the Rosebud Sioux Tribe,  was adopted into a white missionary family when she was 18 months old in the days before ICWA. The only Indian girl in her community, she grew up with a sense of being “different.”

“My adoptive mother constantly reminded me that no matter what I did, I came from a pagan race whose only hope for redemption was to assimilate to white culture,” wrote White Hawk, now executive director of the First Nations Repatriation Institute, on her website.

White Hawk added that people in her community were ignorant of her culture when she was growing up; they would ask her to do rain dances or give war whoops.  Susan Devan Harness, a member of the Confederated Salish and Kootenai Tribes, was also adopted into a non-Indian family at 18 months. Harness said she was called “Squaw Girl” growing up and that she had trouble finding dates in high school because her male classmates’ mothers believed stereotypes that American Indian women were promiscuous– and that dating one would get their sons in trouble.

“I have had privileges,” said Harness of her adoption. “Living in a nice neighborhood, going to college, I have a Master’s Degree…a place at the table. But I have paid a huge price for those privileges."

As part of that price, Harness said she was always fighting for a place of belonging, and that many adoptees exist in an “in between place” between their tribal communities and their adoptive families. White Hawk’s website states that many adult adoptees also show traits of survivors of trauma: anxiety, impulsivity, nightmares, guilt, and unresolved guilt– and that much healing of these issues takes place for adoptees when they reconnect with their tribal identities or “come home.”

“In the beginning I didn’t see the importance of why anyone would want to know my story as an adoptee because I didn’t understand the prevalence,” said White Hawk. “I get it now.”

White Hawk added that reconnecting with her biological family and tribe later in life allowed a “whole new part” of herself to awaken.  She sees similar transformations in the adoptees she works with – as does Karen Vigneault, a librarian who uses her research skills to search genealogy records and connect adoptees with their families.

Vigneault said that adoptees face many obstacles back-peddling through their pasts: opening sealed court documents, misspellings in their ancestors’ names or lack of names which makes tracing families difficult, and apprehension at returning to their communities and families decades later. Despite the challenges, Vigneault provides her help to adoptees free from charge.

“If Creator has people asking me for help, I can’t charge them for that,” Vigneault said. “To help them come home… it should be a free ride.”

A 2009 report published by the Annie E Casey Foundation found that resilience– the ability to bounce back after a traumatic or difficult experience– increases dramatically for American Indian individuals who have seven protective factors in their lives, including:

a sense of belonging to a culture, spirituality, connections to the tribal language and extended family, a sense of humor, a mindset of forward thinking or “moving forward to the seventh generation,” and what authors Charlotte Goodluck and Angela Willeto describe as “responses from the culture”– which could include beadwork, drumming, sweat lodge, talking circles, smudging, pow wows and other ceremonies.

The association between resilience and strong rootedness in tribal culture have significant implications for American Indian children within the foster care and adoption systems today.

Tania Valdez, associate director of the voluntary treatment foster care program La Familia-Namaste, Inc in New Mexico, described the change she saw occur in a young woman in care when an ICWA worker sent her music and books from her Oklahoma tribe.

“I think it plays a tremendous role in her cultural identity. It’s part of who she is,” Valdez said. “She’s removed from her community, but it gave her a piece of her culture, and she embraced that.”

Nikki Kull, executive vice president of The Ranches in New Mexico, said that children in care struggle to transition from one culture to another, regardless of their race.

“We had some siblings from the Yuni tribe who were very connected to their culture… and it was hard for them to be separated from their culture. It’s heart-breaking to see,” Kull said. “I desperately understand the need for kids to stay within their culture, but the fact remains there aren’t enough homes.”

The Indian Child Welfare Act Today
Several judges who spoke with the Navajo Post said that ICWA was meant to be a gold standard for family law cases– that active efforts to work with families before removing children from their homes would be in the best interest of all children regardless of their race.

But lawsuits in several states– Minnesota, Arizona, Oklahoma and Virginia– challenge the constitutionality of ICWA. Common arguments include that the Act’s language discriminates against American Indian children on race alone and that the Act violates due process and privacy rights guaranteed by the Tenth and Fourteenth Amendments.

Judge Tim Connors, who teaches at the University of Michigan Law School and helps train new judges in handling ICWA cases, said that family law is mainly an issue for state courts, so that applying  ICWA– a federal law– to American Indian family cases is a “foreign concept” for many judges.  But he added that American Indian children are particularly harmed when removed from their families.

“Data shows the trauma when we separate children from their communities and their culture and their lineages,” Connors said. “And it is particularly harmful for Native American children.”

Judge William Thorne, vice-president of the National Indian Justice Center and a former member of the Board of Trustees for the National Council of Juvenile and Family Court Judges, said that while some judges and lawyers see ICWA as a violation of their code of ethics regarding fairness, ICWA was created with American Indian children’s best interest in mind.

“In tribal communities, if you cut a child off from their family, grandparents, aunts and uncles, cousins, that really is almost active abuse against that child, because in Indian communities things happen based on relationships,” Thorne said in a video produced by the Mississippi Administrative Office of Courts.

Judge Leonard Edwards, a retired judge who served for 26 years as a Superior Court Judge and six years as Judge-in-Residence at the Center for Families, Children & the Courts, stated that the adversarial processes prevalent in courts– where two or more sides argue their cases and then a “winner” is declared– go against traditional American Indian practices of resolving conflict.  Edwards said that the intention behind ICWA was to help make sure that all of an American Indian child’s resources were being considered.

“Social workers can be creative,” Edwards said. “It’s not mum and dad, it’s the extended family and community. It’s different [in tribal communities] and that can be difficult for our judges to understand.”

While ICWA has been acknowledged by many judges as a difficult law to understand and implement, tribes across the country insist keeping American Indian children connected to their tribes is of utmost importance.

“[If not] They lose the language, the culture, the integrity of what it is to be Native American and the values system,” said Doris Bailon, director of Social Services of the Santo Domingo Pueblo.

Sandra White Hawk and Susan Devan Harness had a suggestion to reduce the number of American Indian children entering the foster care system: providing “front end services.”

“Instead of the money going to clothe and feed kids in foster care, have that money going to strengthen Native families and communities,” Harness said.

The New Normal: DNA & Adoptee Search

I feel like I'm a victim of a witness protection program called closed adoption , though I didn't ask to be... Trace
Reblog from 2014

By Trace L Hentz, Blog Editor

Whenever I have a birthday I think of all the years I searched for my parents. It's true that laws prevented me from ever finding them. Laws didn't stop me. I met my dad in 1995. We did a DNA test to prove paternity. It was 99.9% that Earl was my dad.

(2014) Patricia and I are still finishing up the new anthology CALLED HOME, very important history as a collection of adoptee narratives and the historical truths about adoption in Indian Country.  These voices of adoptees are at the heart of what I do. They are the reason there is a blog AMERICAN INDIAN ADOPTEES.

Right now Karen Vigneault and I are working with about 20 adoptees who are trying to find their families. Because of the adoption laws in the USA, we are seeing the “New Normal” for adoptees is having a DNA test.  They have no choice with the laws not allowing adoptees to have access to our own names, our parent’s names and our tribal nations, and we are still denied our basic rights as human beings and citizens of sovereign nations.

Our adoptive parents who raised us may or may not realize that we NEED information and our ancestry and medical background.  (An adoptee can love more than one set of parents and there is no need to panic!) Adoptees tell me they are afraid to search because of their adoptive parents! That fear has to stop because if you wait, you may never get to meet your mother or father!

One of the adoptees in the new anthology talks about finding new cousins who are trying to figure out who her mother is.

This is the new normal. This is not right but because of the adoption industry and their billion dollar earnings, we adoptees are still at the bottom of the totem pole as far as our rights.

I don’t know how many times I have said to an adoptee do not delay your search. If you do get a name or phone number, make the call. Have a friend with you to keep you calm. Write a set of questions. Just make contact then offer to send a letter explaining what you know about your first family. Send them your phone number so they can call you back.

Give people time to adjust to the truth that you are definitely one of their family members.

If you get your DNA results,  which is the new normal, make contact with cousins who share your DNA! Give them your birth date and let them help you try and figure out how you are all related.

The new normal isn’t fair but we’ll use this until the laws change.

Update: One of the adoptees in the book Stolen Generations is moving to Michigan to start a new life with his parents. He found them using a DNA test. Both his parents were looking for him but didn't know how. Drew found them. He's finally in reunion after 40+ years.

The 2nd Edition of Called Home: The Roadmap has a chapter about using your DNA results to do a court order to open your records.  ICWA has a provision for this. Please read this book.

A system of insanity: Medicating Kids

By Trace L Hentz (a repost from 2015)

My friend Karen Vigneault wrote me an email with this 2015 op-ed http://www.madinamerica.com/2015/03/drugging-children-foster-care/ and said, "So sad, we are such a disposable society."

We are a disposable society. We in America have collectively lost our minds! As I wrote I my memoir, I could have been medicated and drugged for many behaviors as an adoptee/child, but that was the 1960s and they weren’t drugging adoptees then. In order to cope, I had developed an obsessive compulsive disorder.  Eventually my OCD did go away but by then I was a young adult. It helped I had "talk therapy" at age 22.

I also wrote about my foster care training in Oregon when I had 12 weeks of training and one class on “Medicating -- YES or NO"  -- and the social workers showed us a film.  In fact in 1995, YES, drugging was highly RECOMMENDED. They suggested foster parents/adopters get drugs for newly-adopted children and foster children. One father in the film said it was absolutely necessary for his son to be heavily medicated. (I recall there was quite a discussion among 20 of us in this class. I was the only single person getting trained in foster care.)

We have lost our minds (thanks to BIG PHARMA) if we believe drugs help children. It's the opposite!

If you really think about it, “children” are expected to be tranquil, compliant, grateful and act a certain way as children, even though many of us children have been lost and exposed to the gravest injustices being taken from our mothers and families. The children are expected to accept strange new people as parents and smile as though nothing's happened.

I was so afraid as a child.

Reading this latest article, I am very afraid for all the new children thrust into this system of insanity.

Rest in Peace Karen Vigneault, the woman who made miracles | Long-lost Native American Sisters Reunite

Using her own money, Karen traveled to Iceland late last year to meet Guðrún and the Iceland media covered it. Her wish was to reunite Guðrún with her tribe and relatives. She succeeded.[caption]

Guðrún Emilsdóttir, adopted shortly after birth, was 28 before she tracked down her birth mother.
Her birth mother gave Emilsdottir her birth certificate, which named her father, Henry Linwood Jackson.

“My nephew started looking for Henry,” she said.

Eventually, he contacted Native American genealogist Karen Vigneault, a member of the Iipay Nation of Santa Ysabel in California who was profiled in an earlier VOA story.  On Vigneault’s advice, Emilsdottir took a DNA blood test; they uploaded the results onto an online database and waited.

(READ Long-lost Native American Sisters Reunite for a Joyous Thanksgiving)

Emilsdottir has returned to Iceland but is planning to return to Oklahoma in July 2019 for the “Encampment,” a pow wow the Otoe-Missouria tribe has held annually for more than 130 years. It’s an occasion for the tribe to sing, drum, dance and remember their history and traditions. And celebrate family, lost and found.

Henry Linwood Jackson, Otoe-Missouria tribe member, ca. 1965.
BIG READ: Long-lost Native American Sisters Reunite for a Joyous Thanksgiving

The reunion happened because of the tireless methodical work of librarian and tribal genealogist Karen Vigneault (MLIS); she and I have worked together since 2013.

I learned yesterday that Karen has passed away at her home in San Diego.

She made miracles and reunions for adoptees, like these sisters.

It is impossible to put into words the impact she had on me and the lives of many adoptees she helped. She worked to find adoption records, tribal histories, family genealogy and find relatives that adoptees could contact and meet.

This loss is personal and devastating. Not just to me but to readers of this blog who are still searching and hoping and waiting and wanting to find their families.

I will post more when funeral arrangements are announced.

The costs of being adopted

That's me on the right with my adoptive family

By Trace L Hentz

News stories like this one in Missouri enrage me (read below).  31+ states restrict adoptees’ access to their original birth certificates, just like Missouri who is now considering a change. Some states will charge fees in the thousands of dollars for an adoptee to get their own identifying information.

Minnesota is still holding my OBC hostage. WHY? Old laws, old ignorant beliefs. All my parents, birth and adoptive, are dead. Why can't I have a piece of paper that has my real name? Why should I have to pay anything to have it? I didn't ask to be adopted. I didn't ask to have a fake amended birth certificate.

Has anyone else heard of the REAL ID ACT of 2005 that will require we all have documentation as to our identity. The creators of this ACT didn't think of 7+million adoptees - most don't have any real identification?

And let's look at more costs! State Intermediaries also charge adoptees fees: More money we don't have. I spoke with an adoptee last week and she said Lutheran Social Services told her to pay them $1000 and there was no guarantee they'd even find her file. No, they don't give refunds either. REALLY?

(2016) Karen Vigneault and I are still assisting Native adoptees who are trying to find their tribal families. And it's free. But we run into roadblocks with states like Missouri, Minnesota and Utah who are holding Native adoptees own documentation hostage. (look in the reference section to get in touch with Karen or me.) If you need to know information about the state where you live, and how to open your adoption records, please email Karen or me.

The costs of being adopted is not even mentioned in this story below:

Missouri considers easing adoptee birth certificate access

Feb. 6. 2016
JEFFERSON CITY • Danika Donatti first met her biological father when he was in hospice dying from complications of a disease she might also carry.

Donatti, 18, was adopted shortly after birth. She has known the names of her biological parents since childhood but didn’t try to form a relationship with them until she learned her biological father was fighting cancer and a rare genetic disorder, which she had a 50 percent chance of inheriting.

“I could have this and I wouldn’t have known that had I not had my birth certificate,” she told The Associated Press.

Missouri is one of more than 31 states that restrict adoptees’ access to their original birth certificates, according to the American Adoption Congress, a group advocating expanding such access. Adoptees can obtain their original birth certificates only through a court order; they can access their adoption file, which can contain identifying information, if their biological parents give their permission or die.

If the parents cannot be found, the information remains sealed.

Legislation scheduled for a vote on Feb.9 by a Missouri House committee would change that. The Missouri Adoptee Rights Act, sponsored by Rep. Don Phillips, would open access to original birth certificates to adoptees at age 18.

The current law creates hardships for adoptees that should not exist under the U.S. Constitution’s equal protection clause, said Phillips, R-Kimberling City. “It doesn’t say, P.S., by the way adoptees, sorry about your bad luck but you’re not included.”

After an adoption is finalized, a court amends the child’s birth certificate to list the adoptive family as the parents. An adoptee doesn’t need consent to get nonidentifying information about biological parents — which can include a medical history if it was provided at birth.

The current arrangement protects the confidentiality of the birth mother, said Laura Long, and it would be wrong to change that retroactively.

Long, who is an adoptee, works as a confidential intermediary for people seeking their biological parents’ permission to release their identifying information. Many parents consent, she said, but many were traumatized by getting pregnant and placing their child for adoption. People still feel stigmatized by that, she said, and it’s still a secret for some.

The state should respect the wishes of parents who agreed to adoption because of its confidentiality, said Tyler McClay, general counsel for the Missouri Catholic Conference, which opposes the bill. He said a better model is Illinois, which makes identifying documents available unless the biological parents opt out.
The bill is HB 1599.

Disposable Child: Madness in America #DRUGGINGKIDS

http://www.madinamerica.com/2015/03/drugging-children-foster-care/

The Drugging of Children in Foster Care

By PHILIP HICKEY, PHD | Featured Blogs | March 16, 2015

It's no secret that here in America, foster children are being prescribed psychiatric drugs, especially neuroleptics, as a means of controlling their behavior.  A great deal has been said and written on the matter.  Politicians have declared the practice deplorable.  Children's advocacy groups have expressed concern, and, of course, those of us in the antipsychiatry movement have screamed till we're hoarse.  But the problem persists.
For the past six months or so, the San Jose Mercury News, a California newspaper, has been running frequent articles on this topic, calling for oversight and corrective action.
On February 24, 2015, Karen de Sá, a reporter with that newspaper, published an article titled Senate panel examines why California foster care system 'addicted' to psychiatric drugs.  It's an excellent article, which highlights various aspects of the problem, and provides updated information on this matter.

Here are some quotes:
"California's foster care system 'has grown more addicted to mind-altering medication,' the chair of a powerful Senate committee told a packed public hearing in the state Capitol on Tuesday, adding that 'here in California, we've done little to act on this alarming issue.'"
"Lightbourne said two state-sponsored panels have spent years working to develop guidelines that would protect foster children from the excessive use of psych medications and to house fewer kids at residential group homes, where drugs are most frequently prescribed. Foster children deserve 'nonmedical treatments whenever possible,' Lightbourne said."
"'We need to shift our thinking away from the primacy of psychiatric medications toward relationships,' testified George Stewart, a Berkeley child psychiatrist who has spent much of his career tapering severely traumatized children safely off high-risk drug cocktails. 'We are going to look back on this era of great enthusiasm for psychiatric medications and either scratch our heads or beat our heads. We will look back in 20 years and say, 'What were we doing?'"
"Senators also said they were alarmed by the newspaper's analysis that showed how pharmaceutical companies lavish the state's foster care prescribers with millions of dollars for meals, gifts, travel, speaking engagements and research grants -- a practice Lightbourne called 'deeply troubling.' The newspaper found the doctors who prescribed the most, typically were rewarded the most."
All of which tells a familiar story.  Pharma-psychiatry systematically targets foster children as potential customers.  They do this because the residents of foster homes, group and individual, are a "captive audience," in the sense that the foster parent or staff member will ensure that the resident takes the pills.  In this way, non-compliance – the great drain on pharma revenue – becomes a non-issue.
Karen de Sá's article is cogent, articulate, and powerful, and undoubtedly she and her colleagues are raising awareness on this matter.  But there was one paragraph in her article that I felt warranted some additional discussion.
"Tuesday's four-hour hearing before the Human Services Committee highlighted a package of bills being introduced this month, following this newspaper's investigation 'Drugging Our Kids,' which revealed nearly one in four foster care teens take psychiatric drugs -- often to control behavior, not to treat mental illnesses. Most are prescribed antipsychotics, a powerful class of psychiatric drugs with the most harmful side effects."
Note the phrase  "…often to control behavior, not to treat mental illnesses."  What the author is missing here is that, within psychiatry's spurious domain, misbehavior is a mental illness.  In fact, it is several mental illnesses.  If a child is frequently defiant, he has a mental illness called oppositional defiant disorder.  If he is given to outbursts of anger, he has a mental illness called intermittent explosive disorder.  If he is given to violating rules or infringing on the rights of others, he has a mental illness called conduct disorder.  If he is given to setting fires, he has a mental illness called pyromania.  If he is persistently angry and given to very frequent temper tantrums, he has a mental illness called disruptive mood dysregulation disorder.  And, of course, if he is disruptive and inattentive in the classroom, he has attention deficit hyperactivity disorder.  If the child's misbehavior can't be shoe-horned neatly into any of these categories, psychiatry has two residual categories:
other specified disruptive, impulse-control, and conduct disorder; and unspecified disruptive impulse-control and conduct disorder.
Contrary to popular opinion, no neurological pathology is required to establish these "diagnoses."
So, by neatly re-labeling every conceivable kind of misbehavior as a mental illness, psychiatry has established turf in this field, and has legitimized the use of drugs to "treat" this misbehavior.
This is the crux of the entire debate.  There is literally no significant problem of thinking, feeling, and/or behaving that is not listed, either directly, or by implication, in the DSM.  So, Karen de Sá is incorrect.  In the looking-glass world of psychiatry, practitioners are notprescribing major tranquilizers to control children's behavior.  Rather, they are "treating mental illnesses," with medications that have been proven by highly questionable pharma research to be "effective and safe."  We have actually reached the position in our society where a physician who does not follow these practices could be held liable for failure to treat.
And this is the problem.  Every attempt to eliminate, or even reduce, this widespread and persistent practice, is doomed to failure as long as psychiatry's spurious diagnoses are accepted as bona fide illnesses.  Because if childhood misbehavior is an illness, then psychiatrists and other physicians are not using drugs to control behavior, rather they are "treating," compassionately and effectively, these "disabling illnesses."
Psychiatry, over the past five decades, has systematically and deceptively pursued a self-serving policy of medicalizing virtually every significant problem of thinking, feeling, and/or behaving.  Their pharma allies have provided the money, and psychiatry has provided the credentials, in what is arguably the most widespread and destructive swindle in human history.  And they have been enormously successful.  Their spurious notions are widely accepted today as reality.
No significant progress will be possible in these areas until the swindle is finally and utterly exposed, and sanity is restored to our conceptualizations of human activity.  Until then, despite the protests of politicians, advocates, journalists, and others, the pharma-psychiatry maw will remain wide open, and the ranks of "the mentally ill" who need "treatment" will continue to grow.
