My Friend Jeff

Avon man receives long-awaited answers in search for biological family

Jeff Hancock finally received information he'd waited a long time to see: Information in his search for his biological family (WHAM photo)
Avon, N.Y. - An Avon man’s lifelong search has finally come to an end. His long-sought answer came in the mail, and 13WHAM was there to see it revealed.
The letter to Jeff Hancock held the answers for a man whose journey began as a boy, a foster child adopted when he was four.

“When I first found out I was adopted, I felt like a guest at my own funeral,” he said. “The person I had known my whole life was dead. I felt like my whole life isn’t valid to this point, because I wasn’t who I always thought I was.”

Hancock was 42 when he went to apply for a passport and realized he did not have a required birth certificate.
“I said, ‘Mom, I need my birth certificate,’” he recalled. “I actually had never seen it. And she goes, 'Oh, I don't have that anymore.'"
That was when Hancock’s search for his biological family and his original birth certificate began. He joined a group lobbying to unseal state adoption records, giving adoptees access to their birth certificate.
“We just want what everybody else has,” he said.
In 2019, adoptees won the fight for adoption rights. Immediately, Hancock applied for his birth certificate. The COVID-19 pandemic delayed it for months – but, finally, the day Hancock received his letter finally arrived.
“I was five pounds, seven ounces when I was born,” he said, looking over the papers. “I was little.”
“This is something I’ve been wanting to know for a long time: I was born at Booth Memorial Hospital in Buffalo, New York,” he said. “...I learned something today, and I also have confirmation that’s my mom.”
Now, because of the work by Jeff Hancock and others, adoptees in New York no longer have to wait a lifetime for the paper that's a birthright.
“I felt complete for the first time since discovery,” he said.

Too Burdensome to report or keep data on #ICWA (really?)

Adoption and Foster Care Analysis and Reporting System (AFCARS) Notice of Proposed Rule Making. Again.

Here.

We cannot currently track on a national level in any way how ICWA works, where children who are involved in ICWA cases are placed, what their outcomes are, or how many cases are transferred to tribal court, as examples. There is barely statewide data available, and most of it is on a county-by-county level. As just one example, Michigan is in a federal lawsuit over its data collection system.

I am deeply tired of hearing that tracking this information is simply too burdensome for the states that are putting children in care, and then getting hit in lawsuit after lawsuit with claims that are not supported by any data, but also cannot be refuted by data we refuse to collect.

If your tribe wants to submit comments, there will be model comments available before the deadline of June 18.

**
Consider this: The states pay foster parents - the bureaucracy secures money and keep those records, right?
Why not keep data on the kids they place? And did you know that once a child is adopted, no one from the state goes to check on the child(ren)?

read this:

Peter Lengkeek is one of 14 members of the Crow Creek Tribal Council. He said he is enraged by the number of children that the Department of Social Services has removed from his reservation. The Tribal Council recently passed a resolution saying that the state cannot remove children without the council's approval.

#BabyVeronica Case – David v. Goliath

Don't let Ronnie become a LOST CHILD
I have been writing this Op-Ed for INDIAN COUNTRY TODAY MEDIA for a few weeks. There are links to the PR campaign "The Coalition for the Protection of Indian Children and Family" being led by the Christian Alliance and Jessica Munday to "SAVE" Baby Veronica and take from her dad Dusten and they are lobbying to end the Indian Child Welfare Act.

Read here at https://indiancountrytodaymedianetwork.com/2013/08/12/baby-veronica-case-david-vs-goliath

A new comment on ICT:

The PR agent friend Munday's company, Trio-Solutions.com notes that she specializes in social media including edits to wikipedia pages. This might explain why when Munday's PR campaign is brought up on some discussion sites, those posts get heavily downvoted by multiple accounts, which act behaviorally like sockpuppet armies controlled by one firm. Much more disturbing than that is this organization the Christian Alliance for Indian Child Welfare. Their website sells a book "Dying in Indian Country" which establishes clearly that their goal is not just to end the ICWA, but to "fight" tribal "sovereignty", and to pursue a termination policy that ends "the reservation system", which it calls "socialist". Termination of the reservations and of indian sovereignty would of course allow a lot of things, like sales of reservation lands to corporations who need unfettered access to minerals, gas and oil. Who knows who is really behind these web sites or what their real goal is, given the end game they are pursuing would be so convenient to profitable aims for so many non-indian parties. There is an agenda behind this case that has little to do with adoption and everything to do with this being a test case to assault the ICWA and tribal sovereignty. These goals are even stated explicitly when looking closely at the stated goals of some of the players. This knowledge suggests some possibilities about where the mother's "free" attorneys might be getting their incentive to sue the government to end the ICWA, and onwards legally from that step.

Please read and share the link on social media and with your family and friends.....

...and a very revealing yet disturbing update on Christy Maldonado, the birthmother:

Necessary: How my Adoption was like the Baby Veronica case

NEWS: United States Amicus Brief in Support of Affirmance in the Baby Veronica Case

By Trace L Hentz (formerly DeMeyer)

It's important to Native adoptees that the history of the Indian Child Welfare Act of 1978 be placed in the forefront in this case headed to the Supreme Court. It is more than relevant. It is necessary.
A quote from this brief states ..."The case for the ICWA's application here, where the biological father, a member of the Cherokee Nation, wishes to raise his child as a member of the nation, is even stronger."
I spoke with a reporter at NBC News a month ago, and telling him about my own adoption, how my father Earl would have kept me and raised me. The reporter at NBC said I am like an early Baby Veronica case.
Yes, but I was adopted before the Indian Child Welfare Act of 1978 as many Native adoptees were. Federal law did not protect me or my father's rights back in the 1950s. The social workers did not contact my father before I was placed in a stranger adoption. Therefore I lost contact with my relatives and my culture. That is no longer acceptable, since ICWA was passed.
Do the people who wished to adopt Baby Veronica know this history? If not, they need to read the anthology TWO WORLDS and understand how adoptees feel.  Did they ever consider the child's needs above their own?

CONGRESS MADE EXPRESS STATUTORY
FINDINGS THAT “AN ALARMINGLY HIGH PERCENTAGE OF INDIAN
FAMILIES (WERE) BROKEN UP BY THE REMOVAL, OFTEN UNWARRANTED,
OF THEIR CHILDREN FROM THEM BY NONTRIBAL PUBLIC
AND PRIVATE AGENCIES,” AND THAT THE STATES “HA(D) OFTEN
FAILED TO RECOGNIZE THE ESSENTIAL TRIBAL RELATIONS OF INDIAN
PEOPLE AND THE CULTURAL AND SOCIAL STANDARDS PREVAILING
IN INDIAN COMMUNITIES AND FAMILIES.” - Statement in Brief

In my research for both books, I found that Department of the Interior Solicitor Hilary C. Tompkins is an adoptee and Navajo. Tompkins is part of this brief. A story about her ran in the Navajo Times a few years ago.
IN ENACTING ICWA IN 1978, CONGRESS DETERMINED
THAT FEDERAL ACTION WAS NECESSARY TO ADDRESS “THE CONSEQUENCES
TO INDIAN CHILDREN, INDIAN FAMILIES, AND INDIAN
TRIBES OF ABUSIVE CHILD WELFARE PRACTICES THAT RESULTED IN
THE SEPARATION OF LARGE NUMBERS OF INDIAN CHILDREN FROM
THEIR FAMILIES AND TRIBES THROUGH ADOPTION OR FOSTER CARE
PLACEMENT, USUALLY IN NON-INDIAN HOMES.” - Statement from Brief
Keep good thoughts that this important case respects existing federal law and this daughter remains with her father and in her tribe. It is important. It is necessary.
